Study of Tribal Land Alienation in Andhra Pradesh
 
In pursuance of the decision of the Union Cabinet, The Dept. of Rural Development in the Ministry of Agriculture Development, Govt. of India, the study of Tribal Land Alienation in A.P was taken up by TCR&TI, Hyderabad. The study was conducted in 15 districts of A.P.


Finding of the study:-

Total land alienation by form both to Tribal and Non-Tribals

Generally four methods are being adopted by non-tribals in acquiring lands from tribals Viz. Sale, Mortgage, Lease and encroachment. The total extent of land alienated to non-tribals is 1244.98 acres (92.0%) and 42.57 acres (8.06%) to tribals. The tribals sold 506.54 acres of land to non-tribals and 13.00 acres to tribals. Under the category mortgaged lands to extent of 14o.85 acres has been mortgaged to non-tribals under extent of 20.85 acres to tribals. Due to ignorance and helplessness of tribals non-tribals have encroached major part of tribal land (547.52 acres) in the sample which constitutes 40.78% to the total land alienated. Only 54.68 acres was taken over by Government under land ceiling Act from tribals and distributed to landless tribals. Only limited extent of land (57.79 acres) has been given for lease of this 50.07 acres of land was taken by non-tribals and 7.92 acres by tribals.

This major part of land was transferred to non-tribals in the form of sale and encroachment which is about 78.5% of their total land transferred.


PURPOSE OF ALIENATION

Among the sample families surveyed, an amount of Rs.6,68,046 was realized through the process of land alienation. Of this, 73.94% is through sale, followed by mortgage (12.95%) and encroachment (10.08%) with regard to the purpose of alienation, maximum amount 143.82% realized through alienation of land was utilized for performance of marriages, death ceremonies and other rituals and included in others column 25.56% of amount was utilized for consumption and 15.02% was utilized for debt redemption.

This, Tribals are alienating their land mainly to tide over the crises situation like marriage, death etc., which call for heavy expenditure.


I. Background paper on land laws in the Scheduled Areas of A.P:-

In this paper the legislative history of Agency Tracts(Scheduled Areas) from 1707 was given. Was given. The salient features of various Acts Viz., the Scheduled districts Act 1874, the Indian councils Act 1861, the Govt. of India Act 1873, 1919, the agency rules 1924, the A.P scheduled Areas Land Transfer Regulation, 1959, A.P Scheduled Area Land Transfer(Amendment) Regulation 1970, A.P. Scheduled Areas Land Transfer(Amendment ) Regulation 1971, G.O.Ms.No.129 Social Welfare Department Dt.13-08-79, the A.P Scheduled Areas Ryotwari settlement Regulation 1970 are given in the background paper.


II. Note on the Land disputes between Tribals and Non-tribals in certain parts of Area:-

A note was prepared on land disputes between tribals and Non-Tribals in certain parts of agency area of A.P and submitted to the house committee which was constituted to enquire into the above dispute in the agency area.

In this note salient features of Various Acts issued from time to time are given. In this note, the issues of non-tribals and tribals and measures taken by Government in west Godavari and Khammam districts are described.

Note on Land problems in Scheduled Areas & Implementation of Land Transfer Regulation in A.P.

The note was prepared on the basis of data furnished by special Deputy Thasildars of Scheduled Areas of A.P during the year 1999. In this note various acts issued from time to time and the amendments brought in the Acts and salient features of the amendment are discussed. The details of cases booked, extent of land involved, cases disposed extent of land handed over to tribals etc., are discussed in the note.


Survey and Settlement work in the Scheduled Areas:-

The status of survey and settlement work on the Scheduled Area was discussed in the report. The Settlement work taken up under the following regulations ans extent involved was described in the report
